Exclusive Occupancy: Whose House is it Anyway?

In, Goldman v. Abramova-Goldman, 185 A.D.3d 1012 (2020), court granted Plaintiff exclusive use and occupancy of the marital residence as one spouse voluntarily established an alternative residence and a return would cause domestic strife.

In light of the defendant’s voluntary establishment of an alternative residence for herself and the existence of an acrimonious relationship between the parties, Husband gets the residence.
